The buildability of properties is governed by the German Building Code in conjunction with the Hessian Building Code and other planning regulations.
If the respective property is covered by a development plan (Section 30 BauGB), this is the basis for the decision on the buildability of properties. Otherwise, decisions must be made on the basis of § 34 BauGB (so-called unplanned inner area) or § 35 BauGB (so-called outer area).

The lower building supervisory authority at the Main-Taunus-Kreis generally decides on building projects requiring approval (new buildings/conversions and extensions, changes of use, demolition) as well as formal preliminary building inquiries.

Building advice from the city of Hofheim:
The city of Hofheim offers building advice for all building projects in the city area.
In cases that require an exception or exemption from planning law requirements, as well as for decisions affecting the area in unplanned inner areas and for projects in outdoor areas, a magistrate's decision is generally required.

In such cases, the city therefore offers to clarify the municipal consent as part of an informal preliminary building inquiry prior to submitting a building application. This can clarify whether the project - subject to other requirements - has a chance of success from the point of view of the City of Hofheim.

Tuesday additionally: 4 pm to 6 pm

A fee of € 30.00 is charged for the provision of written information in accordance with the administrative fee statutes of the city of Hofheim.
